Welcome to Brand my Bitch (“we,” “us,” “our”), a business operating from 13 Freeland Park, Wareham Road, Poole, BH16 6FA, United Kingdom, through the websites www.brandmybitch.com and www.brandmybitch.co.uk (collectively, the “Websites”). We provide an e-commerce platform powered by Shopify, offering custom temporary tattoos and related services (collectively, the “Services”). All products are manufactured and fulfilled by our specialized partners.

These Terms of Service (“Terms”) govern your access to and use of our Services, including browsing, account creation, and purchasing products. If you do not agree, you must not access or use our Services. These Terms include disclaimers, limitations of liability, and indemnification clauses to protect Brand my Bitch to the fullest extent permitted by law.   2. Account Creation: To access certain features (e.g., placing orders), you may need to create an account. You must provide accurate, current, and complete information during registration, including email, billing, and shipping details. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  3. Account Security: You must not transfer, sell, or assign your account without our prior written consent. Notify us immediately at hello@brandmybitch.com if you suspect unauthorized access. We are not liable for any loss or damage arising from your failure to secure your account.
  4. Accuracy of Information: You warrant that all information provided is true, accurate, and complete. False or misleading information may result in account suspension or termination.

SECTION 2 - OUR PRODUCTS

  1. Product Description: We offer custom temporary tattoos created based on user-submitted text or designs (e.g., social media handles). All products are manufactured and fulfilled by our specialized partners. We strive to display products accurately, but variations in color, appearance, or quality may occur due to device settings or manufacturing processes. We do not warrant that products will meet your expectations beyond their description.
  2. Safety Certification: Our temporary tattoos comply with toy and cosmetic safety regulations in the USA, Canada, UK, Europe, and Australia. Certifications are available upon request by contacting us at hello@brandmybitch.com. Products are not recommended for children under 3 years old, and our Services are restricted to adults 18+.
  3. Product Modifications: We reserve the right to modify, discontinue, or limit quantities of any product at our sole discretion without notice. We may also restrict sales to specific regions or jurisdictions.
  4. Bespoke Nature: All products are bespoke, made to your specifications. You acknowledge that custom products are non-standard and may vary slightly from images or descriptions on our Websites.

SECTION 3 - ORDERS AND NO-REFUND POLICY

  1. Order Process: Placing an order constitutes an offer to purchase, which we may accept or decline at our sole discretion. Orders are not accepted until payment is processed and we send a confirmation email. We may cancel orders for any reason, including payment issues or product unavailability, and will notify you using the contact information provided.
  2. No Refunds or Cancellations: Due to the custom and personal nature of our products, all sales are final. We do not offer refunds, exchanges, or cancellations, including under the EU/UK Consumer Contracts Regulations 2013 14-day cooling-off period, as our products are bespoke and exempt from such rights. At our sole discretion, we may offer replacements for defective products, subject to our limited warranty terms (see Section 9).   3. Order Accuracy: You are responsible for reviewing your order before submission. We are not liable for errors in user-submitted content or order details. Cancellation requests after order confirmation are unlikely to be accommodated due to the automated production process.
  4. Personal Use: You represent that purchases are for personal, non-commercial use and not for resale or export.

SECTION 4 - MANUFACTURING AND FULFILLMENT

  1. Third-Party Manufacturing: All products are manufactured, fulfilled, and shipped by our specialized partners. Brand my Bitch acts solely as a platform facilitating your order and does not manufacture, store, or handle products. All manufacturing-related responsibilities, including quality control, safety compliance, and defect resolution, lie with our partners.
  2. Liability Disclaimer: To the fullest extent permitted by law, Brand my Bitch is not liable for any issues arising from product manufacturing, including but not limited to defects, safety concerns, non-compliance with regulations, or harm caused by product use. Such claims must be directed to us at hello@brandmybitch.com for coordination with our partners.
  3. Partner Role: Our specialized partners handle all aspects of production, including material selection, printing, and quality assurance. Any issues with product quality or safety are governed by their warranty terms (see Section 9).

SECTION 5 - PRICING AND PAYMENT

  1. Pricing: Prices are as quoted at the time of order and may change without notice. Prices exclude taxes, shipping, handling, or customs duties unless stated. We are not responsible for price differences between our Websites and third-party platforms.
  2. Payment Methods: We accept payments in Pound Sterling, US Dollars, and Euros via credit/debit cards or other methods listed on our Websites. You authorize us to charge the provided payment method for all order-related costs, including taxes and shipping. Conversion rates for other currencies are determined by your payment provider.
  3. Payment Accuracy: You warrant that payment information is accurate, current, and authorized. Failed payments may result in order cancellation or account suspension.
  4. Taxes and Duties: You are responsible for all applicable taxes, import duties, or customs charges. Contact your local customs office before ordering to avoid delays or costs.

SECTION 6 - SHIPPING AND DELIVERY

  1. Third-Party Shipping: Shipping is managed by our specialized partners or their third-party carriers. Delivery times are estimates only and not guaranteed. We are not liable for delays caused by carriers, customs, or events beyond our control (e.g., strikes, natural disasters).

  3. International Shipping: For international orders, you are responsible for import duties, taxes, or customs delays. Products may be held by authorities until duties are paid. We are not liable for such delays or costs.
  4. Delivery Issues: If products are undelivered due to incorrect address information provided by you, we are not responsible for reshipping or refunding.

SECTION 7 - INTELLECTUAL PROPERTY AND USER CONTENT

Our Intellectual Property: All content on our Websites (excluding user-submitted content), including text, images, logos, and designs, is owned by Brand my Bitch, Shopify, or our licensors and is protected by UK and international intellectual property laws. You warrant that your content does not infringe any third-party rights (e.g., copyright, trademark, privacy) and is not unlawful, offensive, or defamatory. You are solely responsible for your content and indemnify us against any related claims.
  3. We will investigate and may remove infringing content per our policies.
  4. Content Removal: We may remove user content that violates these Terms or applicable laws at our discretion without notice.

    • Submitting content that is violent, nude, discriminatory, hateful, pornographic, or infringes third-party rights.

We may, at our discretion, coordinate with our partners to replace defective products or refund the purchase price, subject to their warranty terms.
  2. Our Role: Brand my Bitch is not responsible for product defects or warranty claims, as manufacturing is handled by our partners. Any remedies are subject to their policies.
  3. Exclusions: We are not liable for defects caused by your misuse, improper application, or failure to follow product instructions.

SECTION 10 - DISCLAIMER OF WARRANTIES

  1. As-Is Basis: Except as expressly stated in Section 9, our Services and products are provided “as is” and “as available” without warranties, express or implied, including for merchantability, fitness for a particular purpose, durability, or non-infringement.
  2. Third-Party Services: We rely on Shopify for platform services and our specialized partners for manufacturing and fulfillment. We do not warrant their performance, availability, or security. Any issues with these services must be addressed with the respective provider via us at hello@brandmybitch.com.
  3. No Guarantee of Results: We do not guarantee that our Services will be uninterrupted, error-free, or meet your expectations. Product safety and compliance are the responsibility of our partners.
  4. Accuracy of Information: While we strive to ensure accuracy, we do not warrant that information on our Websites (e.g., product descriptions, pricing) is free from errors or omissions. We may correct errors or cancel orders without liability.

SECTION 11 - LIMITATION OF LIABILITY

  1. To the fullest extent permitted by law, Brand my Bitch, its affiliates, and our third-party providers shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages (including lost profits, revenue, data, or goodwill) arising from your use of the Services or products, even if advised of the possibility of such damages.

  3. We are not liable for any harm, injury, or loss caused by product use, shipping delays, or third-party actions (e.g., carriers, customs authorities). Nothing in these Terms excludes liability for death or personal injury caused by our negligence or for fraud.

SECTION 12 - INDEMNIFICATION

  1. You agree to indemnify, defend, and hold harmless Brand my Bitch, Shopify, our specialized partners, and our respective affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including reasonable legal fees) arising from:

    • Your violation of any law or third-party rights.
    • Your submitted content, including intellectual property or privacy claims.
